Appeal decision concerning Marine Le Pen on 07.07.2026: a ruling of symbolic significance for the 2027 presidential election

Paris – 05/07/2026: The Paris Court of Appeal is due to deliver its decision on Tuesday, 7 July 2026, in the proceedings concerning Marine Le Pen. The question is whether the former leader of the Rassemblement National, following the disqualification imposed in March 2025, will legally regain her political capacity to act or whether the sanction will be upheld. At first instance, Le Pen was found guilty in connection with fictitious jobs for assistants at the European level; the ruling included, among other penalties, five years of ineligibility, initially accompanied by immediate enforcement.

During the appeal hearing held in early 2026, the evidence and legal assessments were re-examined. The prosecutor general requested several years of ineligibility as well as other penalties, without systematically abandoning the request for immediate enforcement. The chamber is not bound by these submissions. It may confirm, reduce or suspend enforcement. Annulment of the ineligibility would formally leave Le Pen able to stand for election while appeals are pending; a confirmed ban with immediate effect would effectively end her presence in the campaign.

Politically, the proceedings increase pressure on the Rassemblement National. Two lines are clashing within the party: one is betting on a reduction in the length of the ban or on suspensive effect and keeps Le Pen as its standard-bearer. The other is preparing the transition to Jordan Bardella, who has presented himself for weeks as capable of leading the campaign and strongly criticizes judicial practice. In both scenarios, the party will have to decide quickly on the direction of its platform, campaign financing and alliances on the right in order to remain operational before the 2027 presidential election.

Beyond the individual case, the ruling raises questions of principle: how do criminal penalties interact with electoral law and the presidential timetable? What role will possible additional appeals and review by higher courts play? Observers expect the written reasons to provide clarification on sentencing, the conditions for immediate enforcement and their practical consequences for rights linked to mandates and candidacies.

The Court of Appeal’s decision therefore has immediate consequences for the management of the party leadership, the balance of power on the right and the pace of the pre-election year. Whatever the outcome, the ruling will readjust the strategy at national level: either the RN will have to structure its campaign launch without Le Pen, or it will retain—at least temporarily—the option of entering the decisive phase with its best-known figure.
