Le Pen’s Pourvoi en cassation and the Question of Eligibility: Constitutional Council Decides

Paris – 09.07.2026: Marine Le Pen has filed a pourvoi en cassation after her conviction by the Cour d’appel de Paris in the affair over alleged misuse of European Parliament funds. At the same time she reaffirmed her intention to run in the presidential election in 2027. The move to cassation does not automatically change the legal situation, but it delays the final clarification and keeps the political debate going.

The Cour de cassation does not review findings of fact, but rather the correct application of the law and procedural issues. A pourvoi does not by itself lift the ancillary consequences of a conviction — for example, ineligibility — but it can delay their legal finality. In legal debate reference is made to a 1993 judgment of the Cour de cassation whose scope remains disputed to this day. Several legal experts doubt that this older jurisprudence can be transferred to the present case without reservation, especially since the sanctions and their suspension can be regulated differently.

The authority responsible for the final approval of presidential candidacies in France is the Conseil constitutionnel. Only this body ultimately decides whether a person may run despite a conviction. Until such a determination, eligibility remains formally open. Observers point out that the Constitutional Council, in its review, takes into account not only the result of a possible cassation ruling but also the precise wording of the imposed ancillary consequences and their enforcement status.

Politically, the development increases pressure on the Rassemblement national. Le Pen’s announcement that she will run regardless of the conviction forces the party leadership to clarify roles and the timetable for the election year. Party allies emphasize their support, while internally they point to legal uncertainties that could influence strategic decisions. The public prosecutor’s office is, for its part, examining further procedural steps, including a possible separate pourvoi.

The timing remains central: the Cour de cassation could decide before the official start of the intense campaign phase; that is not guaranteed. If a cassation decision comes late or partially confirms the previous judgments, it would still be up to the Conseil constitutionnel to specify the effects on a candidacy for 2027. One thing is clear: legal certainty only arises with a double clarification — through cassation on legal questions and through the constitutional review of admissibility. Until then, the question of Marine Le Pen‘s eligibility remains a delicate interface between the judiciary, constitutional law and the election calendar.
