Appeals Ruling in the Assistants Case: Cour d'appel Clarifies Sanctions Against Marine Le Pen

Paris – 07.07.2026: The Cour d’appel de Paris on Tuesday, 7 July 2026, issued its decision in the appeal proceedings against Marine Le Pen, the Rassemblement National (RN) and former officials of the Front national. The case concerns allegations that EU funds were improperly used for parliamentary assistants. At its core are staff who were paid from budgets of the European Parliament but, according to investigators, are said to have performed predominantly party-related tasks.

According to court sources, the chamber confirmed parts of the first-instance convictions while adjusting the framework of sanctions. The court found the evidence sufficient in several respects to establish criminal liability and imposed collateral consequences that can go beyond mere fines. These include professional and mandate-related conditions which — depending on their exact form — can directly affect the political scope for action.

The question of a possible Inéligibilité, that is a temporary ban from standing for election, is at the center of public attention. The length and modality of such a measure are decisive. A longer ban could effectively prevent Le Pen from participating in the 2027 presidential election or only allow her to run under conditions. The public prosecutor had sought severe sanctions in advance, while the defense rejected political motives and pointed to the particularities of parliamentary assistant contracts.

Legally, the appeal revolved around three complexes: the distinction between party-political activity and mandate work, the permissibility of internal party instructions toward EU assistants, and the extent to which a party’s organizational structures can give rise to criminal liability. In their reasoning, the judges emphasized, according to trial observers, that EU funds may only be used to support parliamentary work and that internal party purposes must be strictly separated from this.

Politically, the ruling has immediate consequences. Within the RN attention is focused on the leadership around Jordan Bardella, who is likely to come more to the fore if restrictive conditions are imposed. For the party organization, the task is to further disentangle campaign and parliamentary work to minimise future risks. At the same time, the decision increases pressure on other actors to demonstrate compliance structures in the use of EU funds.

Legally, the case is not necessarily concluded with the appeal. The parties may appeal to the Cour de cassation, which, however, only examines points of law. Such a step could extend deadlines and delay the final enforceability of the sanctions. For voters, two things remain decisive for the time being: the specific conditions imposed — including any probation modalities — and the question of who will represent the RN in the first round of the presidential election in April 2027.
