Court of Appeal Upholds Conviction of Marine Le Pen and Reduces Political Disqualification

Paris – 07.07.2026: The Cour d’appel de Paris has upheld the conviction against Marine Le Pen in the case concerning the employment of parliamentary assistants of the former Front National, while at the same time recalibrating parts of the sentence. The court reaffirmed the seriousness of the misconduct found to the detriment of the European Parliament, but adjusted the political disqualification (Inéligibilité) as well as the modalities of the prison sentence. According to the decision, part of the custody is to be served under electronic monitoring, while the length of the Inéligibilité was reduced compared with the first-instance judgment.

The adjustment was justified by noting that a measure that had already taken effect previously had already partially fulfilled the intended protective effect for the integrity of public office. Thus criminal responsibility remains in place, while the sanction is corrected in light of the execution to date. The written reasoning of the judgment emphasizes the separation between criminal punishment and electoral consequences, which are each governed by their own rules.

Politically the ruling has immediate reach: because of the shortened Inéligibilité, Marine Le Pen’s participation in the 2027 presidential election appears in principle possible. Lawyers point out, however, that electoral-law questions — such as the precise calculation of deadlines and eligibility requirements — must be examined on a case-by-case basis. In addition, an appeal to the Cour de cassation has been opened. Until a possible final-instance decision, deadlines, conditions and the exact form of enforcement remain under observation.

The case concerns payments by the European Parliament between 2004 and 2016 to staff who, according to the prosecution, were in fact working on partisan tasks. The investigations go back several years and were also accompanied by the European Anti-Fraud Office OLAF. The conviction in the first instance in 2025/2026 provoked strong political resonance and prompted cross-party debates about compliance rules, parliamentary employment and the control of funds of EU institutions.

With the appeals ruling, the practical implementation of the sanctions now comes to the fore: administrations and courts must coordinate custodial modalities, electronic monitoring and possible ancillary consequences. At the same time, political strategies for the period up to 2027 are being formed. While Le Pen’s supporters criticize the conviction as excessive, critics view the confirmation of responsibility as a signal for the binding nature of transparency and integrity standards. How potential appeals, deadlines and the electoral calendar intersect will depend on the next procedural steps.
