ECJ Allows Age Verification on Porn Sites in the EU

Luxembourg – 16.06.2026: The European Court of Justice (ECJ) has confirmed in a landmark decision that EU member states may require porn sites to verify the age of their users – even if those users reside in other EU countries. This ends a years-long legal dispute between French authorities and operators of porn sites.

The lawsuit was based on French laws that require operators of pornographic content to exclude minors from access. For this purpose, they must install systems for age verification to ensure that those under 18 cannot gain access. Some operators – including Webgroup Czech Republic and NKL Associates, who run the platforms Xvideos and XNXX – viewed the requirements as a violation of EU law and contested them.

The ECJ has now ruled that such national regulations are generally permissible as long as they are proportionate and do not disproportionately restrict the fundamental freedoms of the internal market. At the same time, it clarified that the member state wishing to take measures must first request the member state where the operator is based to take appropriate measures to protect minors itself.

This decision has far-reaching implications for European legislation on youth protection on the internet. It strengthens the rights of member states to enforce their own age verification regulations, even if the sites in question are operated outside their own country. At the same time, it emphasizes the responsibility of platform operators to effectively protect minors.

In France, the ruling led to a tightening of the enforcement of existing regulations. Already in March 2025, an interministerial decree required operators of pornographic platforms based in other EU states to implement age verification systems. Companies such as Aylo, operator of YouPorn and Pornhub, responded with temporary blocks of access in France and initiated legal actions. However, the Conseil d’État, the highest French administrative authority, upheld the obligation for age verification in September 2025 and dismissed the operators’ lawsuit.

With the current ruling, the ECJ sends a clear signal for the protection of minors in the digital space. The decision contributes to the harmonization of youth protection regulations within the European Union and is expected to serve as a basis for similar legal measures by other member states. It shows that national laws on age verification are enforceable even against cross-border providers and thus strengthen the digital responsibility of operators.

In summary, the ECJ ruling marks a key milestone in balancing the fundamental freedoms of the internal market with the protection of youth on the internet. It documents the growing importance of youth protection in the digital age and strengthens the ability of member states to effectively deny minors access to pornographic content.
