Smoking on bathing beaches can cost 135 euros in France

France – 30 July 2026: Anyone who smokes on a French bathing beach during the bathing season risks a fine of 135 euros. Franceinfo reported on Thursday about beachgoers who said they knew nothing about the rule or had not noticed any signs. However, the ban applies regardless of whether signage on site is immediately visible. It was incorporated into French health law through Decree No. 2025-582 of 27 June 2025.

The measure covers beaches at bodies of water that are legally designated as bathing waters, during the locally applicable bathing season. The ban therefore does not apply indiscriminately to every coastline, riverbank or stretch of sand. The start and end of the bathing season depend on local conditions. For holidaymakers, however, the boundaries are not always easy to identify, especially as responsibilities and signage may be handled differently from one municipality to another.

A violation is classified as a fourth-class offence. According to the French Ministry of Health, the fixed fine is 135 euros. Police officers and other legally authorised inspectors may record violations. Ignorance generally does not protect offenders from a penalty. A missing or overlooked sign also does not override the nationwide regulation.

Signage nevertheless remains important for practical implementation. The Ministry of Health has provided standardised notices for the newly covered smoke-free areas. They are intended to inform visitors about the ban and the potential fine. Especially during the holiday season, municipalities and operators must also reach day visitors and foreign holidaymakers who are unfamiliar with French regulations. Where the boundary between the beach, promenade and other areas is unclear, checking local notices is recommended.

The smoking ban on bathing beaches is part of a broader expansion of smoke-free public spaces. Since the decree came into force, additional restrictions have applied, among other places, in public parks and gardens, at bus stops, around schools and sports facilities, and at institutions where minors are cared for or accommodated. The measure is primarily justified by protection from second-hand smoke and the goal of making tobacco use less visible in children’s everyday lives.

Bathing visitors should therefore follow one clear basic rule: smoking is not permitted on beaches at designated bathing waters during the bathing season. Municipalities may also impose further local smoking bans. What matters is the legal classification of the area and supplementary municipal regulations – not merely the presence of a clearly visible sign.
